Independent Educational Evaluations, Preschool

Before I get into my answer to the question I am not an attorney, I don't play one online (not even a little bit) and the information that I am going to provide is not legal advice nor a replacement for legal advice if you need it.

Q: “My daughter recently turned 4 and transitioned into 3-5 Early Intervention. Her OT recommended that she no longer needed OT services. I, however, do not agree with this and mentioned it at the IEP meeting but I don't believe they are moving to add this service. She is diagnosed with Bethlem Myopathy Eds and has a hearing impairment where she will need to learn sign language. I believe OT services are necessary to increase her fine motor skills so that she can learn to communicate. What do I need to do to ensure they add this service to the IEP?”

A: Dear Mom of Preschooler,

First, you are the best advocate for your child. Usually we're told from professionals that "your child will be fine" or "don't worry they will grow out of it". Listen to your mom's instinct!

Your daughter falls under the Part B regulations for IDEA (Individuals with Disabilities Education Act) that services all school age children eligible for special education and related services from age 3-21. Schools run on data and providing the information from your child's specialists on her diagnosed condition is the first start.

I am going to address more than just your OT question as you have made mention that your daughter does have hearing loss and although your question was specific to the OT evaluation, consideration will be needed for related services for audiology and interpreting. Questions to pose - will your daughter have access to a teacher of the deaf/hard of hearing? Will your daughter need an Interpreter? I've linked information from PaTTAN for you that you may find helpful in navigating this area if needed. PaTTAN - Deaf and Hard of Hearing.

You can disagree with any evaluation completed by the school or IU you can request an Independent Educational Evaluation (IEE). I have added the specific regulation below and a sample request letter for you. Being familiar with the regulations that you make requests for is important and reaching out for information is a fantastic.

I wish you well on your journey with your daughter and hope that you have the tools necessary now to get that evaluation to have services provided for your daughter.
